Miffed BCCI Ropes In UK-Based Law Firm, Drafts Notice For ICC

Few days after being outvoted in the ICC board meetings, the Board Of Control for Cricket in India (BCCI) is all set to take legal action against the governing body for violating the Members Participation Agreement (MPA).

The Indian cricket board is miffed with the ICC after the apex body abolished the ‘Big Three’ revenue in favour of introducing a new revenue model, violating the MPA which was signed in 2014. The BCCI was outvoted and the ICC passed the new constitution and the finance model.

According to the new model, based on current forecasted revenues and costs, the BCCI will receive $293 million across the next eight-year cycle, the ECB will get $143 million, Zimbabwe Cricket $94 million and the remaining seven full members $132 million each.

Based on the previous model that is the ‘Big Three’, the board would have drawn an amount of $570 million. And even though the ICC independent chairman Shashank Manohar had initially offered a compromise formula of an additional $100 million, which would push the BCCI’s share to close to $400 million. The BCCI rejected the offer with a counter-offer under which it would still get it’s $570 million but no other full member’s share would be reduced but to no avail.

The BCCI, meanwhile, is not willing to throw in the towel yet and are all set to face the consequences for challenging the ICC. According to reports in The Times of India, the Indian cricket board has roped in a leading law firm in the United Kingdom, has held two conference calls, one between state units and another with its legal team, has drafted a notice citing violation of the MPA and is also ready to pull out of the  upcoming ICC Champions Trophy.

“The question here is not about whether BCCI should be sending the notice or not. A notice will be sent as per the legal norms because it is certainly a violation of an existing contract. The question is, are we prepared for repercussions post sending the notice, “a senior cricket administrator was quoted as saying by the news outlet.

The MPA is registered in the UK courts of law and needs to be therefore brought up for dispute resolution in that country. Also, the BCCI will have to wait for 30 days after sending the notice to the ICC to seek a reply.

However, a law expert said: “The time frame can be a shorter one in cases like this one where the tournament is starting before the deadline and therefore a shorter window can be sought for a reply.”

Another matter that the BCCI will have to consider before issuing a notice is the government’s views. The government has three votes in the BCCI as well.

“This issue is now serious because it’s not just a question of money. It’s now a question of whether India can stand up for what is its right or let it be given away and lose its authority and respect,” a source said.

The report further added that the BCCI is not against the national selection committee announcing the squad for the Champions Trophy following the Special General Meeting on May 7  but want a reply from the ICC at the same time.
