Out of favour Indian fast bowler Munaf Patel has been summoned by a Delhi Court after a city resident Sunil Kumar Aggarwal filed a complaint in a connection with a cheque bounce case. Sunil Kumar filed the complaint against Nivas Promoters Pvt Ltd under the provisions of the Negotiable Instruments Act which had Patel as one of its seven directors.
Aggarwal alleged that despite issuing him a cheque of Rs. 25.50 lakhs last month, it got dishonoured and through a legal notice was issued to the concerned the payment wasn’t coming anytime sooner so he decided to approach the court.
“There is sufficient material on record to summon all the accused persons. Therefore, a prima facie case punishable under Section 138 of the Negotiable Instruments Act is made out against them. This court, therefore, takes cognizance of offence,” the court said when it summoned the cricketer along with his team in the case.
Nivas Promoters Pvt Ltd is a registered company which is dealing with real estate business which started in September 2012. The pacer joined the firm as one of the directors on 1st February 2014 and since then has been an active member in running the company along with other ventures. Agarwal said that the issue of Rs. 25.50 lakhs was dishonoured and despite a legal notice, there were no actions taken by them which forced him to take legal help from the court.
Now after the decision by the Metropolitan Magistrate Snigdha Savaria, Munaf Patel along with 6 other directors of the firm have to appear at the next hearing which is scheduled for 1st November. Munaf was part of the Indian World Cup winning squad in 2011 when the Men in Blue lifted the coveted title after 28 years.
The fast bowler’s career has been hampered due to several injuries all through his career. When he burst on to the scene, Munaf used to regularly bowl at 140 but due to ever recurring injuries, he had to reduce his pace. Munaf was part of the Gujarat Lions squad in the previous IPL, which was his first IPL after 3 years. He managed to play only a couple of matches.
