RCA office-bearers granted reliefby Raajasthan High Court
On Wednesday the Rajasthan High Court granted solace to the office-bearers of the Rajasthan Cricket Association (RCA) by rescinding the no-confidence proposal by which a clique of the Rajasthan Cricket Association (RCA) had eliminated president Lalit Modi and a couple of other office bearers. Declaring the decision and questioning the legitimacy of the Emergent General Meeting which is held by Amin Pathan faction, the Court asked them to show a no confidence proposal in a bona fide manner.
The Rajasthan High Court held that the no confidence motion brought out by Amin Pathan was totally unlawful and erratic, as the meeting was organized without giving notice giving and without the necessary notice period of 3 weeks. The Court also held that even the necessary quorum was not bona fide and the members who reportedly visited the meeting were unofficial. Besides, the meeting was organized in a private hotel rather than the premises of the Rajasthan Cricket Association (RCA). If there would have been an actual notice given then the essential majority for conveying a no confidence motion would have been 25 out of 33.
The Rajasthan High Court held that the Chairman of the Rajasthan Sports Council who is at the time provisionally in charge of Rajasthan Cricket Association (RCA) can pursue to have charge for another 1 month for pre-empting any further issues. In this 1 month time span the respondents are free to order a meeting for no confidence by moving the Chairman Sports Council. According to the Rajasthan High Court if no request is moved the charge would be passed over on 13th March to the office bearers.
